Severe developmental conditions such as autism or Down syndrome

Other cognitive or physical impairments that limit independent functioning
In many cases, this happens because proper planning was never completed—no trust, no power of attorney, and no advanced healthcare directive in place before incapacity.
When that happens, the court must step in.
